• Winner must be a US resident and at least 18 years of age or older.

1. to unconditionally and completely release, hold harmless, indemnify, and defend the Delaware Lottery, the State of Delaware, Facebook, Instagram, Bet Rivers, and their members, agents, employees, officials, representatives, successors and assigns (individually and collectively also referred to herein as “Indemnified Parties”) from any claim, demand, judgment, award, and/or liability arising out of participation in this Promotion, its Drawing, or any related event or occurrence, and/or out of the awarding, receipt, possession, use, misuse, and/or acceptance of a Prize, from any breach of any obligation(s) by any third party(s), and/or from any injury, death, or damage resulting from participation in this Promotion, its Drawing, and/or its Prizes and/or use of its Prizes, even if caused by Indemnified Parties or any other person, whether through negligence or any other cause;
2. to accept and be bound by, as amended if amended, the terms and conditions of all applicable rules, laws, regulations and statutes including all Facebook Rights and Responsibilities and terms including those located at http://www.facebook.com/terms.php?ref=pf and at all links therein; including all Instagram Terms of Use located at http://instagram.com/about/legal/terms/#,; including the Delaware State Lottery Law and its Regulations;
3. to sign any waivers and releases of liability required by the Lottery, and to sign news and press release forms; and to ensure that any of your guests also sign waivers and releases of liability;
   
4. to publicity and to have your, Lottery players’, winners’, guests’, participants’, and users’ name, photos, prize, hometown and/or state posted on the Internet including the Lottery’s website, social media such as Facebook, Twitter, Instagram, and YouTube, and other media, and in other publicity, as well as used in Lottery publications and advertisements, Lottery mailings, and/or other Lottery-related activities, including mailing lists, all at the discretion of the Director;
   
5. that Indemnified Parties are not responsible for any negligence of any person, or for any claim, liability, injury, death, property loss, or other damage of or to Lottery players, winners, and other participants, and/or their family members, or other persons, arising directly or indirectly from or in connection with the participation in or the use or misuse of prizes awarded, or with participation in this Promotion or in any event or occurrence related to this Promotion, including, but not limited to claims for damage to property, for personal injury, illness, or death, or claims based on defamation, rights of privacy, rights of publicity, or delivery of cash or merchandise, or other prize, even if it is caused by the negligence of Indemnified Parties or any other person;
   
6. that Indemnified Parties have not made, and are not responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose;
   
7. to follow and abide by all applicable Delaware Lottery laws, regulations, rules, responsibilities, terms, conditions, and restrictions and these Rules (“Lottery Requirements”), and to agree to release, indemnify, hold harmless, and defend Indemnified Parties for any action or inaction by you which is a violation of any Lottery Requirement;
   
8. that the Lottery reserves the right in its sole discretion a) to substitute for any Prize a prize of approximately equivalent value, or higher, as determined by the Lottery, including a cash equivalent; b) to cancel or reschedule any times and/or dates, including any drawing, and/or c) to cancel or reschedule awarding or fulfillment of any Prize;
   
9. that an entrant, winner, or guest may not request a substitute or equivalent prize; and that actual Prizes may vary;
   
10. that Indemnified Parties are not liable or responsible for any loss, theft, damage to, or destruction of all or any portion of any Prize, whether during delivery or at any other time;
    
11. that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram, and any references to any of Lottery’s products, services, or offerings by trade name, trademark, manufacturer, supplier or otherwise do not constitute or imply endorsement, sponsorship or recommendation thereof by Facebook or Instagram;
    
12. that you and each participant are providing information to the Lottery and not to Facebook or Instagram;
    
13. that the Lottery has the right to remove any Entry or content that violates any of the Rules;
    
14. that any questions, comments or complaints regarding the Promotion will be directed not to Facebook or Instagram, but to the Lottery at https://www.delottery.com/Contact-Us;
    
15. Lottery may collect non-public personally-identifiable information about you in connection with the operation of the Promotion; Lottery’s use of the foregoing information will be subject to Lottery’s privacy policy at: https://www.delottery.com/Privacy-Policy;
    
16. that you hereby consent as required by applicable law to Lottery’s use of all information Lottery is authorized to collect for purposes of operating the Promotion;
    
17. that you hereby expressly consent to, and provide all rights for, Lottery collection of data, and for Lottery sharing and use of data collected as a result of any participation by you in the services, including the Promotion;
    
18. that the Lottery and/or Facebook and/or Instagram may use your information and may contact you;
    
19. that the Lottery owns any and all rights to any data collected; any data collected is collected by Lottery and not by Facebook or Instagram;
    
20. that the following may not participate in this Promotion or its Drawing, and any Entry submitted by any of them shall be invalid:
    
    1. any member, officer or employee of the Delaware Lottery or any individual who is a spouse or domestic partner, child, parent, parent-in-law, or sibling of any member, officer or employee of the Lottery who resides in the same residence as the member, officer or employee;
    2. any officer or employee of any Lottery vendor (including, but not limited to, its advertising agencies; Scientific Games, BetRivers, Facebook, or Instagram) and/or any of their parent companies, subsidiaries, or subcontractors; and/or any member of such officer or employee’s immediate family (spouse or domestic partner, child, parent, parent-in-law, or sibling) who resides in the same residence as the officer or employee;
21. if any discrepancy exists between these Rules and any other material describing the Promotion or anything related thereto, these Official Rules and Conditions of Eligibility shall govern;
    
22. any attempt to deliberately damage the Site, including the Lottery website or the Facebook or Instagram websites or any Lottery Facebook or Lottery Instagram page, or to undermine the legitimate operations of this Promotion and/or its drawing is a violation of the law; Should such an attempt be made, the Lottery reserves the right to disqualify any portion of, or the entire, Internet registration database and the right to cancel this Promotion and/or its drawing;
